J. P. Gillotte, who practices in a medical laboratory at 1505 N. testified that the slug "appeared to be the the girl and marked same one" that he toothufrom while performing an autopsy on her body. On defense questioning! he was unable to state definitely that it was the same bullet, however, and it was not a admitted as evidence until its identity was definitely established the next witness, Simon Lark.

Lark is a police detechnician who was partment given the slug by Dr. Gillotte. Presiding Judge Joseph ermilk of Sullivan Circuit Court overruled Jett's objection that Lark's testimony was based on "hearsay evidence" because the exchange had not occurred in the presence of the accused. Bullet in Brain Dr. Gillottee stated that death was caused by hemorrhages of the brain and spinal cord resultling from the bullet which entered the child's head just below the lower rim of her right eye.

Through cross examination, Jett established that the doctor found no evidence that the child had been sexually molested, as a result of the autopsy. The prosecution contends that Sparks shot the child on Oct. 8, two years ago, after she threatened to tell her parents he had molested her. Sparks, who testified at his earlier bench trial before Vigo Circuit Judge H. Ralph Johnston that he had pointed the death weapon at the girl only to scare her, contends that it discharged accidentally.

City police Det. Chester Wiram, a sergeant at the time of the shooting, was the. third witness called and testified that he and Patrolman Carl Belt were the first officers to arrive at the child's home after the incident. He said he found the girl lying in a doorway between the front room and bedroom, apparently dead, and Sparks in the bedroom talking on the telephone to her mother. Gave Alibi to Police.

Wiram said Sparks told him later as he was being taken to the police station that the girl another child, identicity, fied this morning as "Timmy" were playing with the gun when it was discharged. The pearl handled revolver is owned by the girl's father, Peter Fredericks. Six pictures of the interior of the Frederick's home showing the child's body and illustrating the death scene were introduced as prosecution exhibits during Wiram's testimony. Prior to beginning of testimony Jett was sustained in a motion for separation of witnesses, and five witnesses were directed to leave the court room to be called later one at a time. Both sets of parents were permitted to remain by agreement of Jett and Berry, and Det.

John Ford also stayed in the room. All are expected called to testify course later. Mrs. Norma Fredericks, the mother of the girl, sat in the front row of the public seats next to her husband and showed little emotion except for occasionally pressing a crumpled up handkerchief to her mouth. Parents In Court Spark's parents, seated at the opposite end of the same bench.

also showed no emotion but watched the proceedings intently. Sparks stared straight ahead at the jurors during testimony and seldom glanced at the witnesses.
